What Happens After a Foreclosure Sale

General information about what can occur once a foreclosure sale has been completed.

Immediately after the sale

After a foreclosure sale, ownership of the property generally transfers to the winning bidder, and the former homeowner is generally required to vacate the property within a timeframe set by state law or the terms of the sale.

Handling of sale proceeds

The proceeds from the sale are generally used first to pay the outstanding loan balance, accrued interest, and costs of the sale. If the sale price exceeds those amounts, the remaining funds may become surplus funds, which is discussed in more detail in our article on mortgage foreclosure surplus.

A period worth understanding

This post-sale period is often when questions about remaining value can arise, particularly if the former homeowner or their heirs are not otherwise aware that surplus funds may exist.
