Why an estate can be relevant
When a former property owner has passed away, any funds tied to that person's former property interest may become part of that person's estate, depending on applicable law and how the property was titled.
Formal vs. informal estates
Some families have already opened a formal estate through probate court, with an executor or administrator authorized to act on the estate's behalf. Others have not opened any formal estate, which can add an additional step before a claim can move forward.
General considerations
Because estate administration is a legal process governed by state law, questions about whether an estate needs to be opened, and who has authority to act for it, are generally best directed to independent legal counsel familiar with probate matters in the relevant state.
